What is a Scottish Trust Deed & how does it Work?

Trust Deeds were introduced in the 1980s by the Scottish government to help people gain control of their finances. They use government legislation to agree a manageable monthly payment between you and your creditors.

Trust Deeds exist to help people who are struggling with their unsecured debts. The government introduced revised legislation in 2013 to further improve the previous process. The typical Trust Deed is 4 years in duration but an arrangement can be made to extend the Trust Deed to 5 years if you own your home and want to protect your equity, subject to creditor approval.

Once agreed, all interest will be frozen on your debts and you will make one affordable monthly payment, based on your disposable income,

which once distributed will be used to pay off a proportion of your debt. You should not apply for any credit while in the trust deed, as your intention is to become debt free and it will affect your credit rating when you enter into the trust deed. Remember, if you have missed any payments to your creditors, your credit would already be affected anyway, so it is better to get out of debt and then, rebuild your credit, than stay in debt with bad credit for an undetermined time. Once your trust deed term is finished, any remaining debt will be written off, leaving you debt free!
